Grants for Small Businesses to Provide Comprehensive Workplace Wellness Programs
- The Secretary of Treasury will provide grants to eligible employers to provide their employees with access to comprehensive workplace wellness programs
* Each grant will have a 5 year duration
* An eligible employer is defined as an employer who
- Employs less than 100 employees
- Employees must work 25 hours or more each week
- Employers must not be providing a wellness program as of the date of enactment of the bill (March 23, 2010)
* To receive funding, eligible employers must submit an application to the Department of Health and Human Services which shall include a proposal for a wellness program that meets designated requirements and criteria
Conditions of a Wellness Program
- A wellness program is defined as a program offered by an employer that is designed to promote health
or prevent disease
- Participation may not be based on a health status factor
* Programs such as fitness center rebates and diagnostic testing are examples
- The reward for an individual satisfying a stated wellness program may not exceed 30% of the cost of
coverage
* If dependents participate, the same 30% reward limit applies
- The reward may take the form of a premium discount, rebates, waiver of a cost‐sharing mechanism, or the value of a benefit that would not otherwise be covered under the plan
- Individuals must be given the opportunity to qualify for the award at least once a year
- The reward shall be made available to all similarly situated individuals
- A reasonable alternative standard for obtaining the reward must be made available for an individual
for whom it is unreasonably difficult to satisfy the standard due to a medical condition
